General Terms and Conditions (GTC)
1. Scope
These General Terms and Conditions (GTC) apply to all orders placed by consumers (§ 13 BGB – German Civil Code) or businesses (§ 14 BGB) through our online shop Two Brothers Vintage. Deviating terms and conditions of the customer shall only apply if we expressly agree to their validity.

3. Conclusion of Contract
(1) The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
(2) By clicking the "Buy" / "Buy Now" button, you submit a binding purchase offer. The contract is concluded when we confirm your order by email or dispatch the goods.
(3) During the ordering process, you can correct input errors up until submitting the order (e.g. by using the "back" function of your browser).
(4) Single items / reservations: Many vintage items are unique. Reservation without payment is not possible; sale is subject to availability.
4. Storage of Contract Text
We will send you the order details and these GTC by email. You can view the GTC at any time on our website. For security reasons, order details are no longer accessible via the Internet after completion.
5. Prices, Payment Methods, Due Date; Set-off / Retention
(1) All prices are final prices in euros. In accordance with § 19 UStG, we do not show VAT; shipping costs may apply in addition (see shipping information on the website).
(2) Payment methods: Shopify Payments (e.g. credit/debit card, Apple Pay, Google Pay, Klarna including Sofort, SEPA direct debit, giropay) as well as PayPal.
(3) For instant payment methods / credit card, the charge is made upon completion of the order. Shipping takes place after receipt of payment.
(4) Set-off / retention: The right to set-off exists only with undisputed or legally established claims. A right of retention exists only if the counterclaim is based on the same contractual relationship.
6. Shipping & Delivery
(1) We ship as a parcel via a shipping service provider of our choice. Processing usually takes place within 1–3 business days after receipt of payment (business days: Mon–Fri, excluding public holidays at the shipping location).
(2) Estimated delivery times: Germany 2–4 business days, Europe 2–8 business days, rest of the world 7–15 business days.
(3) Partial deliveries are permitted if reasonable for you. Fixed delivery dates are not guaranteed.
(4) Transfer of risk: For consumers, the risk of accidental loss and accidental deterioration of the goods passes to the buyer upon delivery. For businesses, the risk passes upon handover to the shipping service provider.
(5) For deliveries outside the EU, import duties / customs / taxes may apply, which are to be borne by the recipient.
7. Retention of Title
The goods remain our property until full payment has been made.
8. Right of Withdrawal for Consumers
Consumers have a statutory right of withdrawal of 14 days. The cancellation policy and sample withdrawal form are available on our website and form part of the contract.
9. Liability for Defects (Warranty)
(1) The statutory warranty law applies.
(2) Vintage notice: We sell original vintage items. Signs of wear, discolorations, or small material irregularities due to age/use, as specified in the description/photos, do not constitute a defect.
(3) For businesses, the warranty period is 12 months from transfer of risk; § 478 BGB remains unaffected.
10. Product Presentation, Measurements & Colors
All measurements are taken carefully; permissible tolerance ± 2 cm (± 0.8″). Color representation may vary depending on device/display and does not in itself constitute a defect.
11. Operation of the Shop (Shopify) & Payment Services
Our shop is operated via the Shopify platform. If Shopify Payments is selected, payment processing is carried out by Shopify International Ltd. (Ireland); for PayPal, by PayPal (Europe) S.à r.l. et Cie, S.C.A. The purchase contract is concluded solely between you and Two Brothers Vintage.
12. Transport Damage (Request for Assistance, No Disadvantage)
If goods are delivered with obvious transport damage, please report such defects to the carrier immediately if possible and inform us. Failure to make a complaint has no effect on your legal rights but helps us assert our claims against the carrier.
13. Force Majeure
Events beyond our reasonable control (e.g. natural events, strikes, official measures, disruptions of transport / energy / data / supply networks) extend deadlines by the duration of the disruption and a reasonable restart period. Claims for damages due to delays caused by such events are excluded.
14. Vouchers / Promo Codes (if offered)
Promotional vouchers / promo codes are valid until the specified date, cannot be combined, are non-transferable, and cannot be redeemed for cash. Retroactive crediting to orders already placed is excluded. Minimum order values and exclusions may apply; details are stated in the respective promotion.
15. Online Dispute Resolution / Consumer Dispute Resolution
The EU Commission provides a platform for online dispute resolution (ODR): https://ec.europa.eu/consumers/odr
We are not obliged or willing to participate in dispute resolution proceedings before a consumer arbitration board.
16. Choice of Law, Place of Jurisdiction, Contract Language
(1) German law shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.
(2) For consumers, the statutory place of jurisdiction of their residence applies. For merchants / legal entities under public law, the place of jurisdiction is our registered office.
(3) Contract language is German.
17. Final Provisions
(1) Should individual provisions of these GTC be invalid, the validity of the remaining provisions shall remain unaffected.
(2) We reserve the right to amend these GTC; the version valid at the time of contract conclusion, as published on our website, shall apply.
